BEPS 2.0 in Africa – corporate response to Pillars 1 & 2

This panel will examine the impact for corporations of the efforts by the OECD to address the tax challenges of digitalisation through the Unified Approach as set out in Pillar 1 and analyse the extent to which it will be fit for purpose in the region. We will also be discussing the all-important Pillar 2 and analyse the extent to which this could be an effective means to address tax competition and how MNEs are allocating resources to comply with the many additional reporting requirements under GloBE rules.

Managing transfer pricing controversy & disputes

This panel comes together to explore successful strategies for the management of TP controversy and disputes. Some of the key areas of focus by the panellists include: Responding to the letter of audit findings; determining the grounds of objection and appeal; the merits of the ADR versus other forms of dispute resolution – when to invoke MAP; and finally, if all else fails, how to prepare for trial, selecting expert witnesses, looking at preliminary points to argue etc.

Operational TP – harmonising policies, processes & tech

In this session, we explore the importance of getting OTP right and the practical steps to make tangible improvements. Many TP challenges are typically not about the policies themselves or the documentation but about the execution. While operational TP is often equated to systems or automation, we will explore the importance of strong OTP foundations in delivering accurate policies within a robust governance environment. On the systems & technology side, we discuss the range of available solutions and how to assess their suitability.

The rise of sustainability & ESG in taxation & TP

This session will bring together a diverse range of key stakeholders to cast light on how the tax function can advance the global Sustainability & ESG agenda, which is fast becoming one of the most important Board-level issues for MNEs. Panellists will look at this topic in the round and from multiple angles, focusing on three main areas: taxpayer responsibility, transparency, and sustainability reporting; environmental taxation and the green agenda; and inclusive growth, equality & diversity.
